Mandate and Jurisdiction

    1. Children’s Court

All Magistrates are gazetted to handle children’s matters of a civil and criminal nature. These includes parental responsibility, children’s institutions, custody and maintenance, guardianship, foster care placement, orders for children in need of care and protection, any case in which a person is accused of an offence against a child or in which a child is a victim or complainant, and cases of children in conflict with the law. However, Milimani and Tononoka Courts exclusively deal with children matters.

2. The Anti-Corruption and Economic Crimes Court

The court is established for the purposes of handling cases involving corruption, bribery, economic crimes, and related offences including conspiracy, any attempt to commit or abet the offences.

All magistrates of the rank of Principal Magistrate and above are gazetted to handle these matters. However, Milimani Anti-Corruption Court exclusively deals with corruption matters.

3. Counter-Terrorism Court

The court is established for the purposes of handling cases involving a terrorism act in line with the Prevention of Terrorism Act No.  30 of 2012.  These matters are handled at Shanzu and Kahawa Law Courts.

4. Jomo Kenyatta International Airport Court (JKIA)

This court handles cases involving drugs trafficking, human trafficking, and other offences within the airport.

5. Gender Justice Court (GJC)

The Gender Justice Court (GJC) is a specialized court that addresses sexual and gender-based violence (SGBV) cases. Initially launched as SGBV courts, they were renamed to Gender Justice Courts to combat the stigma associated with the former name. These courts aim to expedite justice for survivors of sexual violence and ensure fair trials.

The first GJC was established at the Shanzu Law Courts in Mombasa in March 2022, and 12 additional courts have since been set up. The GJC focuses on providing swift and fair trials for victims of defilement, rape, and other forms of sexual violence.

6. Mobile Courts

The Judiciary operates Mobile Courts to facilitate access to justice in remote areas where court services are unavailable.

The magistrate, prosecutor, police, and court officials visit the areas on a regular basis and utilize available facilities to conduct court sessions.
