The Small Claims Court is a specialized commercial and civil court whose pecuniary jurisdiction is limited to Kshs.1,000,000/=. Its jurisdiction which is conferred by Section 12 (1) of the Act, is to determine civil claims relating to; contract for sale and supply of good or services, contract relating to money held or received, liability in tort in respect of loss or damage caused to any property or for delivery or recovery of movable property, compensation for personal injuries and set off and counterclaim under any contract.Cases filed at the Small Claims Court must be determined within sixty (60) days.
The Hon. Chief Justice has designated 133 Magistrates to act as Adjudicators. However, only seventy one (71) Adjudicators actively sit and preside over the established Small Claims Courts in forty (40) rolled out courts, while some Adjudicators preside over the matters through the Mahakama Popote Initiative.
